1. Acceptance of Terms
By downloading, installing, or using the CarTune mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App. We reserve the right to modify these Terms at any time, and your continued use of the App constitutes acceptance of any changes.
2. Description of Service
CarTune is an AI-powered mobile application that allows users to upload photographs of their vehicles and generate photorealistic visualizations of potential modifications, including but not limited to body kits, wheels, spoilers, wraps, and other aftermarket parts. The generated images are artistic renderings and do not guarantee the feasibility, safety, or availability of any depicted modifications.
3. User Accounts and Eligibility
You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. User Content
You retain ownership of the photos you upload to CarTune. By uploading content, you grant us a limited, non-exclusive, worldwide, royalty-free license to use, process, and temporarily store your images solely for the purpose of providing the App's services. You represent that you have the right to upload any content you submit and that your content does not violate any third-party rights.
5. AI-Generated Content
The visualizations generated by CarTune are created using artificial intelligence and are provided "as is" for entertainment and visualization purposes only. We make no warranties regarding the accuracy, realism, or feasibility of any generated modifications. AI-generated images should not be used as engineering specifications or blueprints for actual vehicle modification.
6. Prohibited Uses
You agree not to:
- Use the App for any illegal or unauthorized purpose.
- Upload content that is offensive, obscene, or violates any third-party rights.
- Attempt to reverse engineer, decompile, or disassemble the App.
- Interfere with or disrupt the App's servers or networks.
- Use the App to generate misleading or fraudulent content.
- Scrape, harvest, or collect data from the App through automated means.
7. In-App Purchases and Subscriptions
CarTune may offer in-app purchases or subscriptions. All payments are processed through Apple's App Store. Purchases are subject to Apple's terms and refund policies. We reserve the right to change pricing at any time. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
8. Intellectual Property
The App, including its design, features, AI models, and all associated content (excluding user-uploaded photos), is the property of CarTune and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.
9. Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARTUNE AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
11. Indemnification
You agree to indemnify and hold harmless CarTune, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App or violation of these Terms.
12. Termination
We reserve the right to terminate or suspend your access to the App at any time, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the App will immediately cease.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which CarTune operates, without regard to its conflict of law provisions.
